Texas statutes and rules provide notaries detailed guidance on the information that notaries must record in their recordbooks, every time they perform a notarial act.   Keep these requirements fresh in your mind by periodically reviewing: Texas Civil Practices and Remedies Code Title 6, §121.012 (scroll down the page); Texas Gov’t Code Title 4, §406.014 (scroll down the page); 1 Texas Administrative Code §87.40    Standout point:  Since 2007, Texas has prohibited notaries from recording in a recordbook entry the serial number of an identification card or United States passport, or any other number that may lead to theft of the document signer’s identity.  You may record the type of identification provided and the issue or expiration date; for example, “Texas Drivers License, Expires (date).” The prohibition against recording identifying numbers does not pertain to the signer’s house/street number.     The content of this post was provided by the American Society of Notaries.
